How Overtime Pay is Calculated
Overtime pay isn't just your regular hourly rate. According to DOLE, you're entitled to additional premiums based on when you work:
- Regular Overtime: 25% extra on top of your hourly rate for the first 8 hours of overtime
- Rest Day Overtime: 30% extra on top of your rest day rate
- Holiday Overtime: 30% extra on top of the holiday rate (which is already 200% for regular holidays)
- Night Shift Differential: Additional 10% for hours worked between 10:00 PM and 6:00 AM
Many companies calculate overtime based on the basic rate only, forgetting to include the night shift differential for hours worked during night time. This is illegal under DOLE regulations. If you work from 8:00 PM to 4:00 AM, only hours from 10:00 PM to 4:00 AM should get the 10% night differential.
Special Rules for Holiday Pay
Holiday pay calculations can be confusing. Here's a quick breakdown:
- Regular Holiday: 200% of your daily rate for the first 8 hours
- Special Holiday: 130% of your daily rate for the first 8 hours
- Double Holiday: 300% of your daily rate when two holidays coincide
